NOTICE OF CALL FOR BIDS FOR SURPLUS COUNTY PROPERTY
‘PERPETUAL EASEMENT AND LAND LEASE’
WHEREAS, Meade County is the legal owner of the below described property, and
WHEREAS, the Meade County Board of County Commissioners have declared the below described EASEMENT and PROPERTY as surplus pursuant to SDCL 6-13. The Meade County Commission in Sturgis, South Dakota, will receive FIRM sealed bids at the Meade County Commission Office, 1300 Sherman Street STE 212, Sturgis, South Dakota, 57785 up to 11:00 a.m. April 12, 2017 to surplus a Perpetual Easement and Land Lease in Meade County, South Dakota. Bids will be sealed and marked “Cell Tower Land Lease”.
The Meade County Commission reserves the right reject any or all BIDS, to waive any informality in the BID received and to accept the HIGHEST BID that is to the advantage of, and in the best interest of Meade County. The property being sold includes the following:
1. Exclusive Easement of approximate 5,628 square feet located on that part of Lot 11, PLAT OF LOTS 1 THROUGH 12 ALL IN TRACT B OF HOOPER SUBDIVISION, lying in the Northeast Quarter of Section Seven (7) in Township Five (5) North of Range Six (6), East of the Black Hills Meridian, according to the recorded plat thereof, Meade County, South Dakota, described as follows:
Commencing at the southeast corner of Lot 12, said PLAT OF LOTS 1 THROUGH 12 ALL IN TRACT B OF HOOPER SUBDIVISION; thence North 87 degrees 59 minutes 12 seconds West along the South line of said Lot 12, a distance of 152.30 feet; thence North 2 degrees 00 minutes 48 seconds East, a distance of 512.06 feet to the Point of Beginning of the lease area to be described; thence South 87 degrees 16 minutes 18 seconds East, a distance of 84.00 feet; thence North 2 degrees 43 minutes 35 seconds East, a distance of 67.00 feet; thence North 87 degrees 16 minutes 18 seconds West, a distance of 84.00 feet; thence South 2 degrees 43 minutes 35 seconds West, a distance of 67.00 feet to the Point of Beginning;
2. A twelve foot wide Access and Utility easement for ingress, egress and utility purposes over, under and across Lot 11, PLAT OF LOTS 1 THROUGH 12 ALL IN TRACT B OF HOOPER SUBDIVISION, according to the recorded plat thereof, Meade County, South Dakota to the Exclusive Easement; and,
3. That certain Land Lease Agreement (“Agreement”) datedJune 30, 2015 between Meade County (“Landlord”) and TowerCo 2013 LLC, a Delaware limited liability company (in its own right or as successor in interest to New Cingular Wireless PCS, LLC) (“Tenant”) including all amendments thereto and all Landlord rights contained in the Lease.
